

1.1 When using Fresh Box, the client acknowledges that the fees are for personalised services only and as such are not refundable.
1.1(a) Fresh Box contracts out to various registered businesses trading under various names and as such these services that you receive from these contractors are still part of Fresh Box and therefore all Terms and Conditions listed here still apply.
1.2 The Fair Trading Act and the Trade Practices Act requires Fresh Box to acknowledge your request to acquire a service, but the client must choose carefully as choosing the wrong product does not make you eligible for a refund.
1.3 In the case that the client is obtaining the service through the web-site, section 1.2 will not apply and therefore the client is agreeing to the product description and pricing which is listed on the web-site.
1.4 Payments for services will only be accepted by Credit Card.
1.5 Clients must be aware that full payment must be paid prior to the fruit and vegetables being delivered to their nominated address.
1.6 Clients must be aware that FreshBox deals direct with growers and that the produce we receive comes from local, South West, North West or Eastern States growers and is normally picked within 24hours of receiving it.
1.7 In the case that the client receives poor quality fruit or vegetables, FreshBox will double your order of the produce on the next delivery to make up for the poor produce.
1.8 Fresh Box is not liable for any legal or civil action by any client or family member if they are dissatisfied with the Produce or Service at any stage of the process.
1.9 Fresh Box acts in Good Faith and is not responsible if any person that eats the produce delivered by FreshBox becomes sick. In the case the client disagrees with this section, refer to Section 1.10.
1.10 Fresh Box will deliver the produce to the address nominated by the client. In the case that the client is not home, FreshBox will leave the produce in a safe and shaded area.
1.11 In the case that the produce goes missing from the address nominated by the client, Freshbox is not responsible and will not refund any monies. It is the client's responsibility and the client is aware of the risks of leaving produce at a premises that is unattended.
1.12 In the case that the produce becomes spoiled by heat, rain, wind or other unforeseen incidents such as birds, dogs, cats, ants, flies or anything else, Freshbox is not responsible and will not refund any monies. It is the clients responsibility and the client is aware of the risks of leaving produce at a premises that is unattended.
1.13 By reading these Terms and Conditions, the client has accepted all Terms and Conditions and will pay the set amount/s for the service/s prior to obtaining the product through any of the nominated payment options available in Section 1.4.
1.14 Failure to pay Fresh Box via the options available will result in the delay of Fruit and Vegetables being delivered to the client.
1.15 FreshBox will only deliver the Fruit and Vegetables once the payment has been cleared by our merchant facilities bank.
1.16 The customer must be fully aware that it is their sole responsibility to read all of the Terms and Conditions and is therefore liable under all sections. Mistake of Fact or Ignorance of the Terms and Conditions is not a defence and as such the nominated penalties still apply.
1.17 In the case that the Terms and Conditions are not issued to the client, Terms and Conditions are accessible on the Fresh Box Web Page at all times and therefore the responsibility lies with the Client to become familiar with the Terms and Conditions.
1.19 You are aware that by engaging into a service with Fresh Box, you are giving permission for Fresh Box to release your personal information under the Privacy Act to any external agency, State or Federal Government organisation as pleased. Fresh Box saves information received or retrieved from clients in their database and does not delete it under any circumstances.
1.20 The client may request to receive the Terms and Conditions via e-mail or in writing. Please forward your request to our office by emailing admin@freshbox.com.au.
1.21 Our Hours of operation is 24-hours, as this is an on-line ordering system.
1.22 Orders made before midnight will be delivered between 1pm and 6pm the next nominated day.
1.23 The client is made aware that Freshbox is governed by the Fair Trading Act and Trade Practices Act and therefore ask all clients to choose their product carefully, as there is a no refund policy in place.

1.25 The client is aware that prices, conditions, packages are subject to change at any time. The customer will not be informed if Fresh Box decides to add or delete produce from the package or add or delete conditions.
